Nera Pearl Terms of Service

These Terms govern your use of the Nera Pearl online store, including purchases, payments, shipping, returns, and other services offered through the website. By using the site or placing an order, you agree to these Terms.

Product Information

We aim to present product descriptions, photographs, materials, dimensions, colors, and finishes as accurately as possible. Products may include freshwater pearls, shell pearls, mother-of-pearl, pearl-effect elements, sterling silver, and gold-plated sterling silver. Refer to each product page for the materials used in that specific piece.

Natural pearls may vary slightly in shape, size, surface, luster, and color. These natural variations are not defects. Sterling silver may naturally tarnish, and plated finishes can change over time depending on wear, storage, moisture, skin contact, cosmetics, perfume, and chemicals. Product colors may also vary slightly because of screen settings, lighting, photography, and production batches.

Orders

By placing an order, you confirm that the information you provide is complete, accurate, and current. An order-confirmation email acknowledges receipt of your order. We may decline or cancel an order because of a pricing error, unavailable inventory, incomplete information, a payment issue, suspected fraud or misuse, or circumstances beyond our reasonable control. If a paid order is canceled, the payment will be returned to the original payment method.

Prices, Taxes, and Payment

Prices are shown in the currency displayed at checkout. Before completing your purchase, you will see the order total, including products, shipping charges, taxes collected at checkout, and discounts. Payments are processed by third-party payment providers; Nera Pearl does not store complete payment-card details.

International orders may be subject to duties, import taxes, or local fees unless these amounts are collected at checkout. Where applicable, the customer is responsible for these charges.

Shipping & Delivery

Orders are generally processed within 1–3 business days before shipment. Estimated transit times after dispatch are:

• United States: 3–8 business days;
• Canada: 5–10 business days;
• Europe: 3–7 business days;
• Other destinations: 5–12 business days.

Products may ship from partner fulfillment centers depending on availability and destination. You are responsible for providing a complete and accurate shipping address. Delivery estimates are not guaranteed and may change because of holidays, carrier volume, customs processing, logistics disruptions, or other circumstances beyond our control.

Returns, Refunds, and Exchanges

You may request a return within 14 days of delivery. Contact contact@nerapearl.com before returning an item and wait for instructions. Items must be unworn, unused, in their original condition, and returned with the original packaging. Return shipping is paid by the customer unless an item arrived damaged, defective, or incorrect.

Approved refunds are issued to the original payment method after the return is received and inspected. Exchanges are subject to availability. Additional details are provided in our Return & Refund Policy.

Damaged, Defective, or Incorrect Items

Inspect your order upon delivery. If there is a problem, contact Customer Care promptly with your order number, a description, and clear photographs. If the issue is confirmed, we will provide an appropriate remedy, such as a replacement, refund, or another solution required by applicable law.

Product Care, Wear, and Warranty

Use and care for products as intended. Nera Pearl is not responsible for damage caused by misuse, neglect, accidental impact, strong chemicals, cosmetics, perfume, excessive moisture, improper storage, pulling, unauthorized alterations, or third-party repairs. Natural pearl variations and normal sterling-silver tarnish are not manufacturing defects.

Unless a product page states otherwise, any warranty applies only to manufacturing defects and does not cover normal wear, misuse, accidental damage, improper care, tarnish, changes to plating caused by external factors, natural pearl variations, or unauthorized repairs.

Acceptable Use

You may not interfere with the site, attempt unauthorized access, introduce malicious code, use the Services for fraudulent activity, violate another person’s rights, or use the Services in violation of law. We may restrict access or cancel an order when we reasonably suspect fraud, abuse, or unlawful activity.

Third-Party Services

The store may use third-party providers, including Shopify, payment processors, fulfillment partners, carriers, analytics tools, and marketing services. To the extent permitted by law, we are not responsible for interruptions or delays caused solely by third-party providers.

Intellectual Property

All store content, including names, product descriptions, photographs, graphics, logos, visual design, and text, belongs to Nera Pearl or its content providers. You may not copy, distribute, modify, publish, or commercially use this content without prior written permission.

Privacy

Your use of the Services is also governed by our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by applicable law, Nera Pearl will not be liable for indirect, incidental, special, or consequential damages arising from the use of the site, products, or Services. Nothing in these Terms limits any mandatory consumer rights available under applicable law.

Changes to These Terms

We may update these Terms from time to time. Changes apply when published and do not affect rights acquired before the change took effect.

Governing Law

These Terms are governed by Polish law, except where mandatory consumer-protection laws in your country provide otherwise. Nothing in these Terms limits mandatory rights available to you under applicable law.
