Terms of service
TERMS OF SERVICE — NERA PEARL ONLINE STORE
Last updated: September 14, 2026.
This version of the Terms applies to orders placed after it is published on the store's website.
1. General provisions
These Terms set out the rules for using the Nera Pearl online store, placing and fulfilling orders, payments, delivery, withdrawal from the contract, returns, complaints and the services offered through the store's website.
The Nera Pearl online store is operated by:
Kamil Affek, a business owner trading under the Nera Pearl brand
Tax identification number (NIP): 6463018086
Business registry number (REGON): 54070033400000
Business address: ul. Wolska 17, 43-220 Jedlina, Silesian Voivodeship, Poland
Email: contact@nerapearl.com
In these Terms, “Nera Pearl”, “store”, “seller”, “we”, “us” and “our” refer to the business owner operating the Nera Pearl online store.
“Customer”, “buyer”, “you” and “user” refer to a person using the website or placing an order.
A consumer is an individual making a purchase that is not directly related to their business or professional activity.
The provisions concerning consumers also apply to an individual entering into a contract directly related to their business activity where the content of the contract shows that it is not of a professional nature for that individual.
These Terms are available free of charge on the store's website in a form that allows them to be read, saved and reproduced.
By placing an order with an obligation to pay, you accept these Terms of Service and our Return & Refund Policy in the versions made available before you placed your order, including the promotional terms set out in them. This does not constitute consent to marketing or limit your statutory consumer rights.
No provision of these Terms excludes or limits consumer rights arising from mandatory law.
2. Product information
The store makes every effort to present product descriptions, photographs, materials, dimensions, colors, finishes and other information accurately and truthfully.
Detailed information about the material, dimensions, variant, color and other essential characteristics is provided on each product's page.
Products may be made from materials including natural freshwater pearls, Sea Shell pearls, mother-of-pearl, 925 sterling silver, gold-plated 925 sterling silver or other materials specified in the product description.
Products containing natural pearls may differ slightly in shape, size, surface, luster and shade. These differences result from the pearls' natural origin.
However, natural variations must not result in a delivered product that differs materially from the description, type, quantity, quality, appearance or functionality presented in the offer.
Product colors may differ slightly from those displayed on a screen because of device settings, display type, lighting conditions and photography.
925 sterling silver may naturally tarnish over time. Gold-plated elements may gradually change in appearance depending on use, storage and contact with skin, water, moisture, cosmetics, perfume and chemicals.
Natural wear resulting from ordinary use does not in itself mean that a product fails to conform to the contract.
3. Placing orders
Orders may be placed through the store's website.
To place an order, the customer selects a product, its variant and quantity, adds it to the cart and provides the required information.
The customer should provide truthful, current and complete information necessary to fulfill the order.
Before placing an order, the customer receives information about the selected products, their prices, delivery costs, discounts applied and the total amount payable.
An order is placed by using a button that clearly indicates that placing the order entails an obligation to pay.
After placing an order, the customer receives an order acknowledgement at the email address provided.
The sales contract is concluded when the customer receives a message confirming acceptance of the order for fulfillment.
The store may contact the customer to confirm, complete or correct information needed to fulfill the order.
The store may refuse to fulfill or cancel an order in justified circumstances, particularly where:
- the product is unavailable;
- there is an obvious error in the price or product description;
- incorrect or incomplete information has been provided;
- payment has not been made or confirmed;
- there is a reasonable suspicion of fraud, misuse or a breach of law;
- fulfillment is impossible for reasons beyond the store's control.
If an order is canceled after payment has been received, the store will refund the amount received using the same payment method, unless the customer expressly agrees to another method that does not involve additional costs for them.
4. Prices and payments
Product prices are stated in the currency displayed on the store's website.
The applicable product price is the price displayed when the order is placed, taking into account any discounts and promotions applied.
Before completing the purchase, the customer sees the total amount payable to the seller, including the price of the products and the cost of the selected delivery method.
Available payment methods are displayed during checkout.
Payments may be processed by external payment providers. The store does not retain the customer's full payment-card details.
For orders whose transportation begins outside the European Union, import obligations may arise under the rules applicable at the place of import. The rules for these shipments are described in the “Shipping and delivery” section.
5. Promotions and discounts
The store may run promotions and offer discount codes.
The terms of each promotion, including its duration, eligible products and whether discounts may be combined, are stated alongside that promotion.
Discount codes cannot be combined with one another or with other promotions unless the terms of the specific promotion state otherwise.
Discounts cannot be exchanged for cash.
“Buy 2, get 1 free” promotion and returns
Under the “Buy 2, get 1 free” promotion, a customer purchasing three eligible products receives the cheapest of them free of charge. The discount and the amount payable are shown before the order is placed.
When you return products purchased under this promotion, we refund the amount actually paid for the returned products, taking into account the discount allocated to them at purchase. The refund is not based on their price before the discount.
If a single shared discount was applied to a specific group of products at purchase, it is allocated proportionally according to their prices before the discount. The amount allocated to a product is its pre-discount price multiplied by the ratio of the amount paid for that group to the total pre-discount price of the group. This allocation applies only if it formed part of the promotional terms and calculation provided at purchase, and only to the products covered by that shared discount.
If the discount was allocated directly to a particular product at purchase, including a free product priced at 0 in the order currency, the refund follows that allocation. A free product returned on its own does not receive a separate cash refund. We do not reallocate discounts retrospectively for a return or use a single average price for all products.
If you return the entire order, we refund the full amount paid for the products. Delivery costs, refund deadlines and the method of repayment are handled in accordance with section 8 of these Terms. These rules do not limit your right to withdraw from the contract or any other statutory consumer rights. Orders placed before this version of the Terms was published remain subject to the terms applicable when they were placed.
6. Shipping and delivery
Each Nera Pearl order is prepared with attention to detail.
Orders are generally processed within 1–3 business days before shipment, unless a different period is stated for the product or during checkout. Estimated transit times after dispatch are:
- United States: 3–8 business days;
- Canada: 5–10 business days;
- Europe: 3–7 business days;
- other destinations: 5–12 business days.
The total fulfillment time includes both preparation and transit. Delivery estimates may be extended during holidays, periods of increased order volume, carrier congestion, import or customs procedures or other circumstances beyond the store's control.
Delivery costs and any applicable free-shipping offer are shown before the order is placed.
Orders may be fulfilled and shipped directly by foreign suppliers or partner fulfillment centers outside the European Union. For these orders, transportation to the final recipient begins outside the European Union.
Before shipment begins, the goods are not stored by Nera Pearl in Poland or in a warehouse owned by Nera Pearl in another European Union country. A foreign supplier or partner fulfillment center may package the product and hand it to the first carrier.
During transit, a shipment may pass through transfer facilities, sorting centers or logistics centers in third countries or in the European Union. It may be handled successively by several logistics partners and transferred between carriers.
Passing through a transfer facility, sorting center or logistics center in the European Union does not in itself mean that transportation began in the European Union or that Nera Pearl stored the goods there before shipment began.
The final delivery stage in Poland may be handled by InPost or another local carrier.
For shipments whose transportation begins outside the European Union, the final recipient may act as the importer of the goods where this follows from the fulfillment arrangements and applicable law. The shipment may be subject to legally required import, tax or customs formalities.
If additional import charges are collected by the competent authority, postal operator or carrier, the customer may be required to pay them in accordance with applicable law. International orders may be subject to duties, import taxes or local fees unless these amounts have already been collected at checkout.
Nera Pearl remains the party to the sales contract, accepts the customer's payment and is responsible to the customer for product conformity, statutory remedies and the right to withdraw from the contract.
The customer is responsible for providing a complete, correct and current delivery address. If the customer notices an address error, they should contact the store promptly. The store will attempt to correct the information if this is still possible.
The store is not responsible for delays or failed delivery caused solely by an incorrect or incomplete address provided by the customer if correct delivery was not possible despite appropriate steps being taken.
After dispatch, the customer will receive tracking details if they are available for the selected delivery method. Initially, tracking information may not yet be visible in the local carrier's system. A status may appear only after the shipment is handed to the carrier handling final delivery.
For consumer purchases, the store bears the risk of accidental loss of or damage to the shipment until it is received by the consumer or a person designated by them, unless the consumer independently selected a carrier outside the delivery methods offered by the store. The seller cannot exclude this responsibility solely because the problem arose on the carrier's side.
7. Right to withdraw from the contract
A consumer who enters into a contract through the online store may withdraw from it within 14 days without giving a reason.
The withdrawal period begins:
- for an order containing one product, on the day the consumer or a person designated by them takes possession of the product;
- for an order containing several products delivered separately, on receipt of the last product;
- for a product delivered in batches or parts, on receipt of the last batch or part.
The consumer may also withdraw before receiving the product.
To exercise this right, it is sufficient to send an unequivocal statement of withdrawal before the deadline expires. The statement may be sent to contact@nerapearl.com.
A special form is not required for an effective withdrawal. An unequivocal statement, for example by email, is sufficient.
Giving a reason for withdrawal is voluntary. The store may ask for this information to improve its products and service, but not giving a reason does not affect the validity of the withdrawal.
The store will acknowledge receipt of an electronic withdrawal statement by email to the customer.
After receiving the statement, the store will provide the current return address or return-shipping instructions. Contacting the store to obtain a return address is not a condition for an effective withdrawal.
The consumer should send the product back without delay and no later than 14 days after notifying the store of the withdrawal. Dispatching the return before that deadline is sufficient.
The consumer bears the direct cost of returning a product following an ordinary withdrawal unless the store agrees to cover the cost or failed to inform the consumer that they would have to bear it.
Products should be properly protected for return shipping. We recommend registered or tracked shipping and keeping proof of dispatch.
Original packaging is not a requirement for an effective withdrawal. Its absence may, however, be considered when assessing any reduction in value if the packaging formed a significant part of the product or its value.
The consumer may examine the product to the same extent as would be possible in a physical store.
The consumer is responsible for any reduction in the product's value resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning.
Simply opening the packaging, carefully examining the product or normally trying it on does not automatically result in loss of the right to withdraw.
The right to withdraw may not apply to a product supplied in sealed packaging that cannot be returned for health-protection or hygiene reasons after the seal has been broken following delivery, provided the statutory conditions for this exclusion are met.
This exclusion does not automatically apply to every piece of jewelry. The store applies it only where the product was genuinely supplied in sealed packaging and cannot be returned after opening for hygiene reasons.
8. Refunds following withdrawal
If the consumer effectively withdraws from the entire contract, the store will refund the payments received from them, including the cost of the cheapest standard delivery method offered for that order.
If the consumer selected a more expensive delivery method, the store is not required to refund the difference above the cheapest standard delivery cost.
For withdrawal from only part of an order, the original delivery cost is refunded only to the extent required by applicable law, taking into account whether that cost would have changed if the returned product had not been included in the order.
The refund will be made without delay and no later than 14 days after receipt of the withdrawal statement.
The store may withhold the refund until it receives the returned product or the consumer supplies proof of return, whichever occurs first.
The refund will use the same payment method used by the customer unless the customer expressly agrees to a different method that does not involve additional costs for them.
9. Product conformity and complaints
The store is responsible to the consumer for the product's conformity with the contract under the Polish Consumer Rights Act, without prejudice to any mandatory protection applicable in the consumer's country.
A product conforms to the contract where, in particular, its description, type, quantity, quality, completeness, functionality and suitability correspond to the contract, the product description and the consumer's reasonable expectations.
If a product does not conform to the contract, the consumer may submit a complaint to contact@nerapearl.com.
It is helpful to include:
- your full name;
- order number;
- email address used for the purchase;
- product name;
- a description of the problem;
- your requested remedy;
- photographs or a video showing the problem, if these can be provided.
The absence of a photograph, video, original packaging or receipt does not automatically result in refusal to accept a complaint.
The store may request photographs, video or access to the product where necessary to establish the cause and nature of the lack of conformity.
The seller's statutory responsibility for lack of conformity lasts two years from delivery to the consumer, unless applicable law provides a longer period.
The consumer may initially request repair or replacement. The store may replace the product instead of repairing it, or repair it instead of replacing it, if the remedy chosen by the consumer is impossible or would involve disproportionate costs compared with the alternative.
Repair or replacement will be carried out within a reasonable time, without significant inconvenience to the consumer and at the store's expense.
The store bears the necessary complaint-related costs, including return shipping, collection, repair or replacement of a product that does not conform to the contract.
The consumer may request a price reduction or withdraw from the contract in the circumstances provided by law, particularly where:
- the store has refused to bring the product into conformity;
- the store has failed to bring the product into conformity;
- the lack of conformity persists despite an attempted repair or replacement;
- the lack of conformity is sufficiently serious to justify a price reduction or withdrawal without prior repair or replacement;
- the circumstances show that the store will not bring the product into conformity within a reasonable time or without significant inconvenience.
The consumer cannot withdraw from the contract if the lack of conformity is minor, unless applicable law provides otherwise.
The store will respond to a complaint within 14 days of receiving it. Failure to respond within that period has the consequences provided by applicable law.
10. Damaged, incomplete or incorrectly supplied products
The customer should check the contents of the order on receipt. If a product is damaged, incomplete, defective or different from the product ordered, the customer should contact the store.
The store will treat this as a complaint concerning lack of conformity unless the customer expressly identifies another basis for the claim.
Depending on the customer's request, the nature of the lack of conformity and applicable law, the store may offer repair, free replacement, delivery of a missing component, a price reduction or a refund.
The store cannot make the handling of a statutory complaint conditional on accepting a partial discount, keeping the product or choosing a remedy other than one to which the consumer is legally entitled.
11. Exchanges unrelated to a product defect
Customers wishing to exchange a conforming product for another size, color or model may contact contact@nerapearl.com.
A voluntary exchange depends on availability and individual arrangements with the store.
If the exchange does not result from a lack of conformity, the customer may be required to pay the return-shipping cost and the cost of sending the replacement product. The customer will be informed of these costs before agreeing to the exchange.
A voluntary exchange does not limit statutory withdrawal or complaint rights.
12. Product care and natural wear
Customers should use and care for products according to their intended purpose and the instructions provided by the store.
In particular, we recommend:
- avoiding prolonged contact between jewelry and water, moisture, perfume, cosmetics and chemicals;
- removing jewelry before bathing, swimming, exercising and sleeping;
- storing products in a dry place, preferably separately from other jewelry;
- cleaning jewelry with a soft cloth suitable for its material;
- avoiding strong pulling, bending, impacts and other mechanical strain.
The store is not responsible for damage caused solely by improper use, neglect, accidental damage, improper storage, unauthorized alterations or natural wear.
This does not limit the store's responsibility for a lack of conformity existing at delivery or becoming apparent during the seller's statutory responsibility period.
13. Commercial guarantees
Some products may be covered by an additional commercial guarantee if this is expressly stated on the product page, in a guarantee document or in other materials provided to the customer.
The guarantee statement specifies its scope, duration, territorial coverage and how to make a claim.
A commercial guarantee is voluntary and does not exclude, limit or suspend the consumer's statutory rights concerning lack of conformity. The seller's statutory obligations cannot be changed to the consumer's disadvantage.
If no additional guarantee is expressly stated for a product, the statutory rules on product conformity apply.
14. Using the website
Users should use the website lawfully, in accordance with good practice and for its intended purpose.
In particular, users must not:
- provide unlawful content;
- disrupt the website's operation;
- attempt unauthorized access to the store's systems;
- introduce malicious software;
- use the website for fraudulent activities;
- infringe the rights of the store or third parties.
The store may temporarily restrict access during maintenance, updates, outages or security incidents.
15. External services and providers
The store may use external providers, including e-commerce platforms, payment providers, email providers, logistics partners, carriers, and analytics and marketing services.
The use of these services does not limit the store's responsibility to the consumer where that responsibility arises under applicable law.
The store is not responsible for brief technical interruptions caused by independent service providers if it could not prevent them despite exercising due care.
16. Intellectual property
Content available on the Nera Pearl website, including the store name, logo, photographs, graphics, descriptions, videos, layout and other materials, may be protected by copyright, industrial property rights or other rights.
Copying, publishing, distributing, modifying or commercially using these materials without an appropriate legal basis or the rights holder's consent is prohibited.
17. Personal data and privacy
The rules for processing personal data and using cookies are described in the store's Privacy Policy.
Customer data may be shared with parties involved in fulfilling the order, particularly payment providers, foreign suppliers, logistics partners and carriers, to the extent necessary for fulfillment.
If fulfilling an order requires transferring personal data outside the European Economic Area, the store uses an appropriate legal basis and the safeguards required by applicable data-protection law.
18. Liability
The store is liable for failure to perform or improper performance of the contract in accordance with applicable law.
No provision of these Terms excludes or limits liability that cannot lawfully be excluded or limited.
For customers who are not consumers, the store's liability may be limited to the greatest extent permitted by applicable law.
19. Out-of-court dispute resolution
Consumers may use available out-of-court procedures for handling complaints and pursuing claims.
In Poland, consumers may seek help from the competent municipal or district consumer ombudsman, a consumer organization or the Trade Inspection authority. Consumers in other countries may contact the appropriate local consumer-advice body.
Out-of-court dispute resolution is voluntary and requires the parties' agreement unless applicable law provides otherwise.
20. Changes to these Terms
The store may amend these Terms for important reasons, particularly:
- changes in law;
- changes to order-fulfillment arrangements;
- changes to payment or delivery methods;
- introduction of new store functions;
- the need to correct obvious errors or ambiguities.
Amendments do not affect rights acquired by customers before the changes take effect.
Orders placed before a new version takes effect remain subject to the version applicable when the order was placed, unless the change is more favorable to the customer and the customer agrees to its application.
21. Governing law
Contracts concluded through the store are governed by Polish law.
The choice of Polish law does not deprive consumers of protection under mandatory provisions of the law applicable in the country of their habitual residence.
Disputes will be resolved by the competent courts in accordance with applicable law.
